1. About these terms
This website is owned and operated by Jared Holmes Design Pty Ltd (ABN 38 155 761 327, ACN 155 761 327), trading as Jared Holmes Design. In these terms, “we”, “us” and “our” refer to Jared Holmes Design Pty Ltd, and “you” refers to any person accessing or using this website.
These terms govern your use of this website and any enquiry you make through it. By using this website you agree to these terms. If you do not agree, please do not use this website.
2. These terms are not a building contract
Important. These terms apply to your use of this website only. They are not a contract for building work.
Any building work we carry out for you will be governed by a separate written contract signed by both parties. For domestic building work in Queensland, that contract will comply with the Queensland Building and Construction Commission Act 1991, including Schedule 1B where it applies. Nothing on this website varies, replaces or limits the terms of a signed building contract.
If there is any inconsistency between these terms and a signed building contract, the building contract prevails.
3. Licensing
We hold a Queensland Building and Construction Commission licence and carry out building work in accordance with it. Our licence number is published in the footer of this website and can be verified on the QBCC licensee register at www.qbcc.qld.gov.au.
We only undertake work that falls within the scope of our licence.
4. Website content
We aim to keep the information on this website accurate and current, but we do not warrant that it is complete, accurate, current or free from error.
Information on this website is general in nature. It is not advice, and it does not take account of your particular property, site conditions, budget, council requirements or circumstances. You should not rely on it as a substitute for professional advice specific to your project.
Project descriptions, photographs, timeframes and any figures shown on this website are illustrative. They describe past or current work and do not represent what will be achieved on your project. Photographs may show work that includes contributions from designers, certifiers, engineers, subcontractors and suppliers.
5. Enquiries, quotes and estimates
Submitting an enquiry through this website does not create a contract between us and does not oblige us to provide a quote or to carry out work.
Any indicative figure, budget range or estimate we give before a site inspection is an estimate only and is not binding.
A written quote we issue is an offer capable of acceptance, subject to the following:
It is valid for the period stated in the quote, or 30 days from its date if no period is stated
It is based on the scope, drawings, specifications and site information available to us at the time
It assumes reasonable site access and does not include latent or concealed conditions unless expressly stated
It may be subject to change if the scope changes, if approvals impose additional requirements, or if material or subcontractor prices change before acceptance
Work does not commence until a written contract is signed by both parties and any required deposit is paid
6. Intellectual property
All content on this website, including text, photographs, graphics, layout, design and the Jared Holmes Design name and logo, is owned by us or used with permission, and is protected by copyright and other intellectual property laws.
You may view this website and print or download extracts for your own personal, non-commercial use. You must not otherwise reproduce, adapt, publish, distribute or commercially exploit any part of this website without our prior written consent.

You agree not to:
Use this website for any unlawful purpose or in any way that breaches these terms
Attempt to gain unauthorised access to this website, its server or any connected system
Introduce any virus, malware or other harmful code
Use any automated system to scrape, copy or harvest content or contact details from this website
Submit false, misleading or abusive information through any form on this website
Use any content from this website in a way that suggests an association or endorsement that does not exist

10. Your consumer rights
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law, including guarantees that services will be supplied with due care and skill and will be fit for purpose.
Where our liability can be limited by law, our liability for a failure to comply with a consumer guarantee in relation to services is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
Domestic building work in Queensland may also be covered by the statutory warranties under the Queensland Building and Construction Commission Act 1991 and by the Queensland Home Warranty Scheme. Those rights apply in addition to your rights under the Australian Consumer Law.
11. Limitation of liability
Subject to clause 10, and to the maximum extent permitted by law:
We provide this website on an “as is” basis and exclude all warranties in relation to it that are not expressly set out in these terms
We are not liable for any loss or damage arising from your use of, or reliance on, this website or its content
We are not liable for any indirect, consequential, special or incidental loss, or for loss of profit, revenue, opportunity or data, arising in connection with this website
Nothing in this clause limits our obligations under a signed building contract.
12. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these terms and is available on this website.
13. Changes to these terms
We may update these terms from time to time. The current version will always be available on this website, and the date at the top shows when it was last updated. Your continued use of this website after an update means you accept the revised terms.
14. Governing law
These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and any courts that may hear appeals from them.
15. General
If any part of these terms is found to be unenforceable, that part is severed and the rest of the terms continue to apply.
Our failure to enforce any provision of these terms is not a waiver of that provision or of our right to enforce it later.
